I think it's time for another propane pricing check. I got a notice from AmeriGas today. They will now charge a $100 when they remove their tank, when you switch to another company. Tank rental we go by geographic location. Their "Fuel Recovery Fee will be $7.76. Their HazMat & Safety Compliance fee will be $9.69. The late charge will be 1 1/2% or $36, whichever is greater. There is a "Service Termination Charge of $100.00. They also have $120 "Pump-Out/Restocking charge for any tank they pick up that has more than 5% propane left in the tank. Meter Service fee, $9.99. Service Dispatch Charge is $54.99 ... due when they get there to put propane in your tank.
Under "# 7: Title To Equipment, you can't let anyone, even yourself touch the tank and it's equipment and you must notify them within 30 days, when you plan to sell you home.
# 8: Access to Equipment: AmericGas may, without prior notice, enter Customer's property to deliver propane or to install, repair, service, or remove the leased equipment, or to perform any other services that it deems necessary under the Terms and Conditions. Customer agrees to provide AmeriGas with safe, free and unimpeded access to the leased equipment, including, but not limited to, access free of ice, water, mud and other debris, as well as to provide a driveway that is sufficiently sturdy to withstand the weight of a filled propane truck. Customer will mark or otherwise identify the location of septic systems, leach pits, underground ponds and similar underground features as necessary to install the leased equipment, perform services and make deliveries. Customer agrees to promptly surrender to AmeriGas the leased equipment when customer terminates customer's relationship with AmeriGas for any reason.
# 9: Limitation of Liability: Under no circumstances will AmeriGas be liable for incidental, consequential or special damages, including without limitation damage to customer's plumbing (and water damage from frozen pipes), driveway and or landscaping.
# 12: Excused Performance: AmeriGas will not be responsible for any delay or damages caused by events or circumstances beyond its reasonable control, including without limitation, ... AmeriGas' inability to obtain propane or equipment from its customary suppliers, terminal, refinery or pipeline disruptions, allocation programs, lack of or inadequate transportation facilities, ... Under any of these or similar circumstances, AmeriGas may allocate propane and equipment among its customers in any manner that AmeriGas , in its sole judgment, deems reasonable.
# 13: Change to the agreement: ... By accepting delivery of propane or by paying any fees, rates, or charge after customer has been given notice of the changes(s), customer will be deemed to have agreed to the changes(s). (That's once they mail you a notice of any kind)
# 16: you now agree to arbitration should you have any problems with AmeriGas.
