It is illegal to video tape without consent and in the public right of way.  In the report you indicated the man parked his car on the street.  Can't record a crime in the street.  It would have been different if it was in his driveway and the camera show the area of coverage was primarily his property. 

I have cameras installed on my property in Lake Mathews and made sure of this by having an officer view the area of coverage and checked with my brother who is an attorney.  We had the same installer and I would think he would have installed them at my mom's house in the same manner. 

Can't be too careful now a days.  So for anyone that has cameras out there be sure they are properly set so that it is obvious your intent is to focus on your property even if it slightly includes neighboring property. It will make the difference between it being used for your protection, against you or simply thrown out of the courts.

Cameras? Whoa Nellie! That's another thing our "justice" system seems to have a problem with. I believe it was earlier this year, there was a report of a man being arrested for installing cameras on his house to record thefts or vandalism being done to his car while it was parked on the street. He caught the perpetrators on tape, turned it in to the police, and they promptly made an arrest. No, the criminals went free. It was the homeowner that was arrested and charged with a crime.

Although I haven't found it, there must be a statute on the books somewhere that victims shall not interfere in any way with a criminal exercising his god-given right to commit a crime.

After all, isn't that why cities install street lights so criminals won't hurt themselves tripping over anything while ripping off your house? It also gives taggers better light to paint their hideous images by.

I asked my mother this morning and stated she didn't mention the weapon to the officer but I guess they know now if they are reading this.  I haven't had a chance to ask my nephew if he mentioned it to the police.   Probably not.
Funny how an innocent person can get shot, raped, so forth and have to try to prove it.  But if the innocent attempted to protect themselves they would probably be arrested on the spot. Go figure.

I am just happy they didn't return last night and things didn't go any further than it did. Right now we are trying to see if the cameras recorded anything.  That's the one thing my mom has difficulty with is modern gadgets.

I'm curious, what did the police say about your mother brandishing a firearm? California is one of the states that panders to criminals. This is not a "stand your ground" state, unfortunately. There are far too many instances where a homeowner has been arrested for confronting someone in the process of a criminal act on their property, instead of the criminal. We on this hill are anywhere from 15 minutes to two weeks away from law enforcement responding to a call. Far too often, we just can't win.

Good Afternoon:
Two men and one female possibly from Central America on motorcycles entered my mother's home on Multiview during the evening around 10pm.  They had their dog with them and decided to jump in the pool and take a swim.  Motorcycles were black and the other red.  Once my mom and nephew realized the had trespassers and figured it would take the police ten minutes at least to arrive she decided to take action on her own.  She confronted them and apparently they thought the house was vacant at the moment and invited themselves in.  She told them it's private property and they are trespassing and she is giving them an opportunity to leave now or (click as the heard the gun/rifle). They got out of the pool slowly and walked to their motorcycles and left.  Shortly thereafter the police arrived and so did my other family members.  I don't know who these people are and I live close to my mom on Via Barranca.  If the trespasser happens to be reading this he/she/they can call me directly at 951.722.5678.  For all the rest of the good neighbors in Lake Mathews be on the alert for these up to no good free loaders.
